Seller Terms and Refund Policy

Flat Fee MLS Services offered (collectively, the "Services") are provided under the following terms and conditions of service and use (the "Terms"). Please read them carefully. You understand and acknowledge that the Services are provided to you exclusively under these Terms. By accessing and using the Services, you agree that you have read and understand the Terms and that you agree to be bound by them, without limitation or qualification. As used on this Web site, the terms "we", "us", or "our" refer to dsm-fsbo.com and dsm-fsbo.com.

  • If your buyer is not working with an agent the total commission is 0%. (no agents = no commissions)
  • The Listing Agent total commission is 0%. (a la carte services available if you need help later)
  • The Buyer Agent total commission is 3% (you may offer 2.5% but it is not recommended... it's quite popular to offer 3.5% when listing flat fee - more showings and more incentive for buyer agents to work direct with the seller.)
  • Your Flat Fee MLS listing will be provided by a REALTOR® licensed in Des Moines. Even though technology allows you to "submit your own MLS Listing" - your MLS# can ONLY be obtained by a REALTOR®. Your 0% commission listing agent is a member of the Board of REALTORS® and adheres to a strict code of ethics as set forth by the National Association of REALTORS®.
  • To qualify for 100% refund you must make your request *within 30 days. **Full refund is paid at closing by your listing agent.
  • You are required to sign a listing contract with your broker. You can cancel or re-negotiate your listing agreement at any time.
  • Your MLS listing will be created using the data you submit here on this website. In some areas the MLS requires a signed property profile form.
  • Your signed and faxed (or digitally signed and emailed) MLS Listing Agreements must be received by the REALTOR® before your MLS Listing ID# can be activated.
  • You can edit your listing here on this website as often as you like using the seller control panel.
    • When you edit your listing here you'll find your changes on google, yahoo, frontdoor, zillow, trulia and hundreds more in 4-48 hours.
    • You're required to order a status change request from our online store if you want the changes applied to your MLS and realtor.com listings.
    • Status change request orders provide an area for you to make notes - simply provide your property ID or URL and tell us what we need to update. (usually price, description, new images or new sort order)
    • When you order a status change request, a "Status Change Request Form" (required by the local MLS) will be sent to you via email. Please complete the form and fax or email it to your broker.
If you violate any MLS rules, Fair Housing Laws or HUD guidelines that result in a fine to your listing broker you agree to be 100% liable for those fines. 
  • This addendum is only in place to eliminate harmful actions or malicious intent to cause harm to your broker's status or reputation by those who would intentionally violate laws in an effort to do the broker harm.
